1. Acceptance of terms

Please read these Terms of Service ("Terms") carefully before using safesignals.io or any SafeSignals products or services ("Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms. These Terms constitute a legally binding agreement between you and SafeSignals LLC ("SafeSignals," "we," "us," or "our").

2. Services

SafeSignals provides credit card skimmer detection hardware (WiFi Sensor Units and PoE Sensor Units) and a cloud-based monitoring platform that analyzes wireless signals to detect the presence of unauthorized skimming devices near payment terminals.

Use of the Services is also governed by the applicable subscription agreement executed at the time of sign-up (the WiFi SMB Subscription Agreement or Enterprise MSA), which is incorporated into these Terms by reference. In the event of a conflict, the subscription agreement controls for matters specific to your subscription.

3. Account registration

To use the Services, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your password secure and not share it with others.
• Notify SafeSignals immediately of any unauthorized use of your account at [email protected].
• Accept responsibility for all activity that occurs under your account.

SafeSignals reserves the right to suspend or terminate accounts that violate these Terms.

4. Acceptable use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Services for any unlawful purpose or in violation of applicable laws or regulations.
• Reverse engineer, disassemble, decompile, or otherwise attempt to derive the source code or underlying technology of any SafeSignals hardware or software.
• Interfere with or disrupt the integrity or performance of the Services or related systems.
• Attempt to gain unauthorized access to any SafeSignals system, account, or data.
• Use the Services to collect, store, or process personal data about individuals beyond what is necessary for fraud detection at your own business locations.
• Resell, sublicense, or otherwise make the Services available to third parties without a separate written dealer agreement with SafeSignals.
• Modify, tamper with, or damage SafeSignals hardware.
• Use automated tools (bots, scrapers, etc.) to access the SafeSignals dashboard or APIs except as expressly permitted.

5. Subscriptions and billing

SafeSignals Services are available on a subscription basis. Current pricing is available at safesignals.io. By subscribing, you authorize SafeSignals to charge your payment method on a recurring basis at the interval (monthly or annual) you selected.

• Monthly subscriptions renew automatically each month unless cancelled with 30 days' written notice.
• Annual subscriptions renew automatically each year unless cancelled before the renewal date.
• Prices may change with 60 days' prior written notice to your account email.
• You are responsible for all applicable taxes.

6. Intellectual property

All intellectual property rights in the Services, including the website, software, hardware designs, patent-pending wireless signal classification technology, trademarks, logos, and documentation, are owned by SafeSignals LLC.

These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Services during your active subscription for your internal business purposes only. No other rights are granted. You may not copy, reproduce, distribute, or create derivative works from any SafeSignals content without prior written permission.

7. Disclaimers

SafeSignals is a detection and alerting service. It uses commercially reasonable efforts to detect skimming devices but does not guarantee detection of every threat or prevention of every fraud loss. You remain responsible for responding to alerts and for any financial losses that occur.

Alert delivery depends on third-party carriers and email services. SafeSignals is not responsible for delays caused by third-party systems.

8. Limitation of liability

In no event will SafeSignals be liable for any indirect, incidental, special, exemplary, consequential, or punitive damages, including loss of profits, loss of data, loss of goodwill, business interruption, or the cost of substitute services, even if SafeSignals has been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, SafeSignals' liability is limited to the greatest extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless SafeSignals and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Services or violation of these Terms.
• Your violation of any third-party right, including any intellectual property, privacy, or proprietary right.
• Any claim that your use of the Services caused damage to a third party.

10. Termination

SafeSignals may suspend or terminate your access to the Services immediately and without notice if you materially breach these Terms, fail to pay amounts owed, or engage in conduct that SafeSignals reasonably believes poses a risk to the Services or other users.

You may terminate your account at any time by cancelling your subscription per your subscription agreement and contacting [email protected].

Upon termination, your right to use the Services ceases immediately. Sections 6 (Intellectual Property), 7 (Disclaimers), 8 (Limitation of Liability), 9 (Indemnification), and 12 (Governing Law) survive termination.

11. Changes to these terms

SafeSignals may update these Terms from time to time. When we make material changes, we will notify you by email and update the "Last updated" date at the top of this page with at least 30 days' advance notice. Your continued use of the Services after the effective date constitutes your acceptance of the revised Terms.

If you do not agree with the updated Terms, you may cancel your subscription before the effective date.

12. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the State of [STATE], without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Services shall first be submitted to informal negotiation. If unresolved within 30 days, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association, conducted in [CITY, STATE]. Class action waivers apply — you may only bring claims in your individual capacity.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.
